Terms of Service

These Terms of Service (“Terms”) govern your use of the Acudacity Dental Demo SMS program operated by Acudacity, Inc. (“Acudacity,” “we,” “us,” or “our”). By enrolling in or using the SMS program, you agree to these Terms.

Program Description

Acudacity Dental Demo SMS provides appointment reminders and confirmations, rescheduling assistance, educational messages related to procedures and post‑visit care, and related patient communications on behalf of the Practice.

Enrollment and Consent

• You may enroll by submitting the opt‑in form at smsoptin.html, by providing consent to the Practice, or by other documented consent methods permitted by law.
• Your consent to receive SMS is not a condition of receiving treatment or purchasing any goods or services.
• You must be 18 or the parent/legal guardian of the patient, or otherwise authorized to receive communications on the patient’s behalf.

Opt‑Out and Help

• To stop receiving messages, reply STOP at any time. You will receive one final message confirming your opt‑out.
• For help, reply HELP or email binod@acudacity.com.

Frequency, Fees, and Carriers

• Message frequency varies based on appointments and your interactions with the Practice.
• Message and data rates may apply.
• Wireless carriers are not liable for delayed or undelivered messages.

User Responsibilities

• Provide accurate contact information and promptly notify us or the Practice of any changes.
• Do not use the program to transmit unlawful, harmful, or abusive content.
• If you share a mobile device or number, ensure the account holder and all users consent to receive messages.

Privacy

Your use of the program is subject to our Privacy Policy, which explains how we collect, use, disclose, and protect information. We do not sell or share your mobile phone number, SMS consent, or message data with third parties for marketing or promotional purposes.

Healthcare Notice

Messages may relate to healthcare services provided by Acudacity Dental Demo. Do not include sensitive medical information in SMS replies. For private clinical matters, contact the Practice directly. We implement safeguards aligned with HIPAA requirements when handling healthcare information on behalf of the Practice.

Service Availability and Changes

We may modify or discontinue the program, or update these Terms, at any time. Changes are effective upon posting. If required by law, we will provide additional notice.

Disclaimers

The program is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non‑infringement.

Limitation of Liability

To the maximum extent permitted by law, Acudacity will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from or related to your use of the program. Our aggregate liability will not exceed one hundred (100) U.S. dollars.

Governing Law
